Payment made to the Trebor Specialties, Inc. (Trebor Specialties) must be made without discount in United States dollars at Atlanta, GA pursuant to the terms set forth by the agreement between Buyer and Trebor Specialties. In the event Buyer does not pay amount due pursuant to the terms of the agreement between Buyer and Trebor Specialties, Buyer agrees to pay delinquent late fee of 6% and late charges of 1-1/2% per month pursuant to the laws of the State of Georgia. Checks returned from the bank for insufficient funds, stop payments and chargeback’s are subject to fee.
Buyer agrees to immediately examine product ordered from Trebor Specialties upon receipt of delivery. Buyer agrees to advise Trebor Specialties of any defective product in writing within 10 days of receipt and to return all requested defective product to Trebor Specialties within 30 days of original shipment after written authorization. Buyer also agrees that they will examine Trebor Specialties’ invoices and statements immediately upon receipt, and they will advise Trebor Specialties of any transaction disputes in writing within 10 days of receipt. Failure to notify Trebor Specialties of any dispute or defective goods within 10 days and/or non-return of defective goods within 30 days of original shipment shall constitute a complete waiver of any and all such disputes.
Buyer may only return product with prior written authorization, all returns must be accompanied by a Trebor Specialties return authorization number written on the outside of the shipping container. Stock items from the same shipment may be returned freight prepaid in complete, resalable, damage free condition, subject to a 20%-50% restocking fee, within 30 days of original shipment for Trebor Specialties company credit. Special Order, Custom Order and/or non-stock product items manufactured and/or imprinted specifically for you cannot be returned.
Trebor Specialties will be reimbursed for reasonable attorney’s fees and cost of collection on, or assignment of, any non-payment or past-due bill, regardless of whether judicial action is undertaken. The Buyer agrees that the jurisdiction and venue for any dispute under this contract are proper in Cobb County, State of Georgia.
